Palestinians threaten to take Israel to the ICC over settlements

TEL AVIV //Palestinians threatened yesterday to take Israel to the International Criminal Court over the construction of about 2,610 homes in the first new Jewish settlement in east Jerusalem for 15 years.

The unprecedented legal action may be open to Palestine after its recognition by the United Nations last month as a non-member observer state.

Their threat follows the approval yesterday by the Jerusalem municipal committee of construction of a new settlement in a hilltop area in south-east Jerusalem known as Givat HaMatos.

The site is mostly empty except for several dozen rundown trailer homes inhabited by Israelis unconnected to the settlement enterprise, and building new homes would establish a new permanent neighbourhood, according to the Israeli anti-settlement group Peace Now. The group said the site would be the first Jewish settlement in east Jerusalem since Har Homa in 1997, while Benjamin Netanyahu was in his first term as prime minister. He is now in his second term and targeting a third in elections next month.

Mohammed Shtayyeh, who was the Palestinian Authority's special envoy for the UN bid, warned yesterday: "The intensification of settlement activity and all the Israeli actions, from killings to arrests, are pushing us to accelerate our recourse to the International Criminal Court."

Hanan Ashrawi of the Palestine Liberation Organisation's executive committee said the Givat HaMatos plan was "extremely dangerous". "Israel is defying and provoking the international community as though it wants to punish everyone who voted in favour of a Palestinian state at the UN."

Ms Ashrawi said Palestinian officials were weighing several actions to take against Israel, including "judicial accountability". She declined to say in which international legal body such moves may be carried out.

With their new UN status, the Palestinians may have access to bodies such as the International Criminal Court in The Hague, where they can file complaints related to settlement construction - viewed as illegal by the international community - and other offences.

Also yesterday, the Israeli housing ministry gave final approval for about 1,000 new homes in West Bank settlements, some deep inside the Israeli-occupied territory required by Palestinians as part of a future independent state.

The two approvals came two days after Israel gave the green light for the construction of 1,500 new homes in the east Jerusalem settlement of Ramat Shlomo, a move that drew an unusually strong rebuke from the United States, Israel's staunchest ally, and from the European Union.

Anti-settlement activists and Palestinian leaders say the Givat HaMatos construction would be especially damaging to the creation of a Palestinian state because it blocks access to east Jerusalem from the southern parts of the West Bank. The Palestinians view east Jerusalem as the capital of their future state, which they also want to include the West Bank and the Gaza Strip.

Mr Netanyahu was adamant yesterday about constructing homes for settlers in east Jerusalem despite international criticism. At a meeting with foreign ambassadors, he said: "Jerusalem has been the capital of the Jewish people for 3,000 years. Imagine that you would limit construction in your own capital, it doesn't make sense."

Mr Netanyahu, who commentators say is vying for more right-wing support with the settlement construction plans ahead of the election, said Israel will "build in Jerusalem for all its residents, this is something that has been done by all previous governments and this is something that my government will continue to do".

Hagit Ofran, director of the settlement watch project at Peace Now, said the Givat HaMatos plan was one of the most damaging for the future creation of a Palestinian state, along with this month's announcement to advance building in the so-called E1 corridor near Jerusalem.

Ms Ofran said construction would complete the isolation of east Jerusalem from the southern areas of the West Bank. It would especially isolate the east Jerusalem Palestinian village of Beit Safafa, which is already surrounded by the Israeli settlements of Har Homa and Gilo, and hinder more than 10,000 inhabitants from reaching the West Bank city of Bethlehem.

"Beit Safafa will be an enclave inside Israel without a connection to the West Bank. In effect, you will not have Palestinian continuity from the West Bank to all the Palestinian neighbourhoods of east Jerusalem," Ms Ofran said.

The plan's approval would now be followed by the issuing of construction tenders, Ms Ofran said, a process that could take several months to a year.

Sami Ershied, a lawyer and activist from Beit Safafa, said the village's residents would now have little possibility to mend an acute housing shortage in the community, which he said needs at least 600 more homes for young families.

Specific proteins secreted by cancer cells circulating in the bloodstream could help diagnose cancer earlier, but the quantity of these biomarkers is so low that detecting them has proven difficult.

Now MIT researchers, led by Sangeeta Bhatia, have developed nanoparticles that interact with cancer proteins to produce thousands of biomarkers that can be easily detected in the patient?s urine.

This biomarker amplification system could also be used to monitor disease progression and track how tumors respond to treatment, says Bhatia, the John and Dorothy Wilson Professor of Health Sciences and Technology and Electrical Engineering and Computer Science at MIT and a member of MIT?s David H. Koch Institute for Integrative Cancer Research.

The search has been complicated because genomic studies have revealed that many cancers, such as breast cancer, are actually groups of several diseases with different genetic signatures, she says.

The MIT team, working with researchers from Beth Israel Deaconess Medical Center, described the new technology in a paper appearing in?Nature Biotechnology?on Dec. 16. Lead author of the paper is Gabriel Kwong, a postdoc in MIT?s Institute for Medical Engineering and Science and the Koch Institute.

Amplifying cancer signals

Cancer cells produce many proteins not found in healthy cells. However, these proteins are often so diluted in the bloodstream that they are nearly impossible to identify. A recent study from Stanford University researchers found that even using the best existing biomarkers for ovarian cancer, and the best technology to detect them, an ovarian tumor would not be found until eight to 10 years after it formed.

?The cell is making biomarkers, but it has limited production capacity,? Bhatia says. ?That?s when we had this ?aha? moment: What if you could deliver something that could amplify that signal??

Serendipitously, Bhatia?s lab was already working on nanoparticles that could be put to use detecting cancer biomarkers. Originally intended as imaging agents for tumors, the particles interact with enzymes known as proteases, which cleave proteins into smaller fragments.

Cancer cells often produce large quantities of proteases known as MMPs. These proteases help cancer cells escape their original locations and spread uncontrollably by cutting through proteins of the extracellular matrix, which normally holds cells in place.

The researchers coated their nanoparticles with peptides (short protein fragments) targeted by several of the MMP proteases. The treated nanoparticles accumulate at tumor sites, making their way through the leaky blood vessels that typically surround tumors. There, the proteases cleave hundreds of peptides from the nanoparticles, releasing them into the bloodstream.

The peptides rapidly accumulate in the kidneys and are excreted in the urine, where they can be detected using mass spectrometry.

This new system is an exciting approach to overcoming the problem of biomarker scarcity in the body, says Sanjiv Gambhir, chairman of the Department of Radiology at Stanford University School of Medicine. ?Instead of being dependent on the body to naturally shed biomarkers, you?re sampling the site of interest and causing biomarkers that you engineered to be released,? says Gambhir, who was not part of the research team.

Distinctive signatures

To make the biomarker readings as precise as possible, the researchers designed their particles to express 10 different peptides, each of which is cleaved by a different one of the dozens of MMP proteases. Each of these peptides is a different size, making it possible to distinguish them with mass spectrometry. This should allow researchers to identify distinct signatures associated with different types of tumors.

In this study, the researchers tested their nanoparticles? ability to detect the early stages of colorectal cancer in mice, and to monitor the progression of liver fibrosis.

Liver fibrosis is an accumulation of scarring in response to liver injury or chronic liver disease. Patients with this condition have to be regularly monitored by biopsy, which is expensive and invasive, to make sure they are getting the right treatment. In mice, the researchers found that the nanoparticles could offer much more rapid feedback than biopsies.

They also found that the nanoparticles could accurately reveal the early formation of colorectal tumors. In ongoing studies, the team is studying the particles? ability to measure tumor response to chemotherapy and to detect metastasis.

The research was funded by the National Institutes of Health and the Kathy and Curt Marble Cancer Research Fund.

A cosmic holiday ornament, Hubble-style

Dec. 18, 2012 ? 'Tis the season for holiday decorating and tree-trimming. Not to be left out, astronomers using NASA's Hubble Space Telescope have photographed a festive-looking nearby planetary nebula called NGC 5189. The intricate structure of this bright gaseous nebula resembles a glass-blown holiday ornament with a glowing ribbon entwined.

Planetary nebulae represent the final brief stage in the life of a medium-sized star like our Sun. While consuming the last of the fuel in its core, the dying star expels a large portion of its outer envelope. This material then becomes heated by the radiation from the stellar remnant and radiates, producing glowing clouds of gas that can show complex structures, as the ejection of mass from the star is uneven in both time and direction.

A spectacular example of this beautiful complexity is seen in the bluish lobes of NGC 5189. Most of the nebula is knotty and filamentary in its structure. As a result of the mass-loss process, the planetary nebula has been created with two nested structures, tilted with respect to each other, that expand away from the center in different directions.

This double bipolar or quadrupolar structure could be explained by the presence of a binary companion orbiting the central star and influencing the pattern of mass ejection during its nebula-producing death throes. The remnant of the central star, having lost much of its mass, now lives its final days as a white dwarf. However, there is no visual candidate for the possible companion.

The bright golden ring that twists and tilts through the image is made up of a large collection of radial filaments and cometary knots. These are usually formed by the combined action of photo-ionizing radiation and stellar winds.

This image was taken with Hubble's Wide Field Camera 3 on October 8, 2012, in filters tuned to the specific colors of fluorescing sulfur, hydrogen, and oxygen atoms. Broad filters in the visible and near-infrared were used to capture the star colors.

The Six Essential Leadership Attributes | Self improvement tips

Leadership is the foundation for all organizations, whether corporate, nonprofit or government. Leadership is a high calling and responsibility, upon which all else the organization is or does rests. Moreover, leadership is always top down, never bottom up.

Therefore, much has been written on the subject of leadership and many writers and speakers have tried to list those attributes they believe are essential for leaders. However, most often these attempts focus upon traits that make a leader personable, affable and popular. The following six attributes are results of character and personal integrity and as such are deeply seated within those who possess them. They must be developed through self-discipline, time and pressure; they are not inherited; and cannot not feigned, at least not for long. Such attributes are the result of instruction, commitment and a deep concern for what is right, as well as for the best interests of others. They are modeled on a daily basis. Tested and proven in times of trial and adversity. Moreover, they are as precious as gold and equally rare.

Attribute #1 of Leaders ? Set High Standards

Leaders set high standards for themselves and those who follow. I am reminded of leaders like Booker T. Washington, who began with a vision, not of what was, but of what could and should be. Born a slave shortly before the outbreak of the civil war, he taught himself to read. As an adult, he saw the need to establish a college for ex-slaves, who were excluded from the existing higher education system. When he first arrived at Tuskegee, AL, where he had expected initial funding and a building suitable to his purpose in founding the Tuskegee Institute, he found only ruins. At this point, most of us would have given up or decided it was not the right place or time, retreating to wait for a better turn of circumstances. Instead Booker T. Washington began by teaching his students to garden, so that they might eat and sell the excess to raise the funds necessary to buy books. Then he taught them to make bricks from which to build the buildings and for sale to raise cash for the other materials needed. Booker T. Washington knew that nothing of true value resulted from any course of action other than by hard work. Indeed, this was his motto and a foundation upon which his students began their education. He set high standards for himself and his students and he expected results.

Attribute #2 of Leaders ? Live Your Standards and Mentor Those Who Follow

Leaders live up to the standards they have set and mentor those who are attempting to follow them. Many leaders are consistent in demanding of themselves compliance with the standards that they espouse. Those who do not are only fooling themselves. Nothing disqualifies a would-be leader faster than a double standard, one for them and another for those under their authority. Anyone who thinks that they can maintain such a charade is sorely mistaken. Their subordinates will soon see through their duplicity and loyalty will rapidly be replaced by disgust and only grudging obedience and lip service.

Where most leaders fail however, is in mentoring those who follow. For some reason leaders expect that their followers will learn through osmosis, how to attain to the standards set by their leadership. Certainly, modeling by the leaders is a necessary component of the process, but much more is needed. You do not train a child from infancy on through adolescence by modeling proper behavior alone. It takes consistent, concerted effort verbally communicating not only what is expected, but how. Yet for some reason, most leaders think that merely establishing the standards is all that is necessary. Effective leaders invest themselves into their followers. The best example from all of history is Jesus. He spent three years teaching, mentoring, and living out his standards intimately before a dozen followers, who later set the Roman world on fire. In that short three year period, Jesus? disciples came to see, accept and claim His vision as their own and the remainder of their lives clearly reflected His profound impact upon them. He became to them the embodiment of the standards He espoused.

Attribute #3 of Leaders ? Create and Share a Vision

Every successful leader must instill the vision of where the organization is going and what is necessary to attain that goal. Without a vision, there is no unity. I am constantly amazed at the number of organizations that continue year after year in a near total absence of vision and therefore unity. In the corporate world, research and development departments create products and services for which there is no market, manufacturing continues to produce items with which customers are dissatisfied, find difficult to assemble and use. Engineering creates designs that are costly and inefficient to manufacture and customer service forces customers to endure a labyrinth of voice mail selections and web site menus that frustrate and confuse customers seeking a ?real? person with whom to speak.

Even in organizations that tout themselves as ?visionary?, all too often this vision extends to only some aspects and functions of the organization. Rarely does it permeate its essence and fully to its core. A splintered vision or one that is implemented in a fragmented manner will always result in competing interests and elements within the organization, vying for resources, each thinking their particular function and sphere of effort is most important. Winston Churchill had an enormous task in the war years following the demise of the Chamberlin government. How to unify and develop Britain?s terrified populace and rapidly dwindling industrial base into a single cohesive force with the will to defeat Nazi Germany, despite the seemingly impossible odds and specter of impending invasion. What did Churchill say at such a critical hour in Britain?s history? ?I can offer you only blood, sweat, toil and tears?, was his call to the nation. He certainly did not sugar coat his message. Britain responded with everything its people had, hanging on through seemingly ceaseless bombings, rocket attacks and finally the Battle of Britain. His words of encouragement, simply: ?Never, never, never give up.? He possessed a singular vision in those dark days of World War II, before the United States entered the war against Nazi Germany and he communicated it ceaselessly to a nation that hung on by a

thread.

Effective leaders are driven by a singular vision, not of what is, but of what is to become and they make sure that everyone around them understands and buys into that vision.

Attribute #4 of Leaders ? Make the Hard Choices When Necessary

Effective leaders are characterized by a willingness to make the hard decisions when necessary. Gene Krantz, the Apollo 13 Houston Flight Director provides an excellent example. Half way to the moon on a ?routine? space mission, an on-board explosion rips the outer shell of the spacecraft, damaging critical life support and propulsion systems. The best solution is also the one that appears most impossible. Continue the mission to the moon and use its orbit as a slingshot to return the three astronauts to earth. The only problem is that they lack the necessary life support and power for a trip that long. Krantz?s answer; declare first that no astronauts will be lost on his watch. ?Failure is not an option?, no matter how impossible the present dilemma appears. Then make the irreversible commitment to the best course of action. The explorer Cortez burned the boats, thus making retreat impossible. Yet it is human nature that at times of extreme crises, the majority wants to keep their options open. True leaders, however, recognize that for the organization to reach the desired goal there must be total concentration on the chosen solution and everyone must know that going back is not an option.

Attribute #5 of Leaders ? Be Visible and Out Front

Leaders, to be respected, must be visible. That is visibly out front. The unseen leader is the leader not followed. Visibility is critical and fortunately in our age of global telecommunications, this is easily done. However, being visible and being ?out front? are not necessarily one in the same. Marriott Hotels is interesting in their practice of very conspicuously placing a painting of the Marriott?s, father and son, in the lobby of each hotel. Why did they do that? Vanity? No. Identity. To both their clientele and staff, this father and son team was present and leading the way, not just from their presence in their painting, although it was certainly a constant and graphic reminder that someone was actually at the helm. Everyone in the Marriott organizations knows someone is ultimately responsible and furthermore, they know who that someone is. Everyone knows where the buck stops, as Harry Truman would say. In today?s far flung organizations spanning contents, in your organization, whatever its size, do people really know where the buck stops? Do they, customers and staff alike, have a clear and constant sense that someone, a real person, not voicemail, is really in charge? And more than in charge, do see you as their leadership, being out in front, or merely locked away in some ivory tower corporate office, out of sight and out of mind.

General George Patton is a classic example of out front leadership. Old blood and guts George. His men loved him and his men hated him, often at the same time. Patton had a reputation for incurring the heaviest casualties in the opening hours of every conflict in which he engaged, and his troops knew it. They also knew that he had the lowest casualty rates per engagement, because he was unafraid to commit his resources unsparingly and without regard to the lives that would be lost in so doing. He knew that to save the most men from death, he must be willing to endanger the most and yes, send some to their deaths, in some cases, many. His troops also knew one other thing about their leader. That when he sent them into combat, no matter how savage, he, General George Patton, would go with them. Leading from out-front. A habit for which, he was repeatedly subjected to criticism from his superiors. Contrast this with General William Westmoreland in Vietnam. Clearly there were many reasons for the morale problems suffered by U.S. troops during the Vietnam War and no one cause can be singled out as overriding, but the fact that as his infantrymen lay in the muddy rice patties, watching their buddies dying for a cause they did not understand, they also knew that their commanding general was dining daily in Saigon, on gourmet food served on fine china and linen table cloths, served by G.I. attendants wearing starched white waistcoats and white gloves. Patton?s response to his superiors when criticized for his exploits at the frontlines of battle was characteristically that, ?he knew no way to lead from behind?.

Attribute #6 of Leaders ? Instill Hope in Those Who Follow

The final attribute of successful leaders is their ability to instill hope. None of us can continue to grow, develop and perform at our highest potential without hope. Hope for success, hope for recognition and reward and most importantly, hope that indeed we can make a difference in the long-term outcome. Hope supplies the essential fuel that enables the human spirit to continue moving forward, especially in the face of severe adversity. This was the context in which President Lincoln spurred the North forward in light of the Union?s defeat after defeat in the bloody carnage of the Civil War. A hope that at the end of the long and terrible night, we would emerge once again as one nation and that this time, all men would be able to enjoy the privilege of being free.

Conclusion

We live in a time when cynicism and doubt, especially in regard to leaders and their motives are rampant in every area of our culture, including not only corporate, but also government and nonprofit organizations. Would be leaders, to be effective and ultimately successful, must demonstrate to those they expect to lead, the personal integrity required to develop within themselves these six attributes. To live out these attributes, not perfectly, but humanly, including failing, admitting failure and learning from it. Thereby, leaders can instill within their followers the loyalty and commitment necessary for them to accept the high standards the leader sets, models and mentors; adopt the leader?s vision as their own and accept the inevitable hard decisions; for their leaders are out front, visible; providing hope for the future.

In addition, some websites also allow pop-up advertisement, which most internet users really dislike the interference of the flow of browsing. ?While a certain amount of advertising is understandable and acceptable. ?The point here is making the amount of ads to a minimal in order not to discourage visitors to the site from browsing through the site content.

How To Carrier Unlock Samsung Galaxy Note 2 Permanently [Tutorial]

That sounds pretty good, except for one thing that could make a big difference for many. While the user gets the smartphone at a much lower rate from the wireless carrier, it gets locked down to that particular network for a certain period of time under the contract, meaning that the user cannot use a SIM card from another network during that time.

Although most users generally agree to this rule, there might be instances when you don?t want to continue with the same network provider any longer if you find the services unsatisfactory. In addition, while traveling abroad, you want roaming on your smartphone, but don?t want to use a local carrier that is partnered with the cellular service provider you?re currently subscribed to.

If you happen to experience such situations, a carrier unlock is what you should go for. These smartphones are locked using some complex software code and the hardware is nothing to do with it. Hence, there?s always a way to unlock the device, allowing the users to go for the carrier of their choice.

Thanks to the talented minds over at XDA-Developers, here is a tutorial for Samsung Galaxy Note 2 owners who want a network unlock for their devices. Developers have managed to uncover a hidden menu in Samsung?s own software that allows unlocking a pre-locked device.

Before going ahead with the unlocking process, there are some factors to consider:

- Ensure that the phone is actually locked.

- The phone must be running at least Android 4.1 Jelly Bean or higher.

- This method is tested with Galaxy Note 2 N7105. However, it is reported that it works for the N7100 - and some Galaxy S 3 models as well (not guaranteed).

- The users must note that IBTimes will not be held responsible for anything that goes wrong. They should proceed at their own risk.

Method

Step 1:?On the Samsung Galaxy Note 2, launch the phone app and dial the following keys:

*#197328640#

Step 2:?From the Main Menu, navigate to [1] UMTS > [1]Debug Screen > [8] Phone Control > [6] Network Lock > Options.

Step 3:?In the Options screen, choose [3] Perso SHA256 OFF. After choosing this option, wait for 30 seconds.

Step 4:?Now go back one step by pressing the Menu button and then select Back once. You should now be in [6] Network Lock.

Step 5:?Choose [4]NW Lock NV Data INITIALLIZ. After that, wait for a minute.

Step 6:?After a minute, reboot your Galaxy Note 2.

The phone should now be carrier unlocked and ready for any SIM card to be used. It should be noted that there won?t be any confirmation related to a successful unlock on the phone. You need to insert a SIM card from a different carrier to check it.

New Small Fission Reactor For Deep-space Missions Demonstrated

My father was is the first lot of troops into Nagasaki and he stayed there for as part of the Japanese Occupation Force. They were given no warnings about radiation, no protective equipment, and allowed to pick and pry wherever they wanted among the ruins. HIs photos were taken from pretty much every part of the city.

He had no health problems that could be attributed to radiation. Those of his friends and shipmates who were there also were the same. In every case when they suffered serious ill health it was due to smoking or drinking.

What I have noticed though is curious congenital conditions occasionally popping up in their children, about 1 child in 4 or 5, when there was no history of it previously. This may or may not be coincidence but while these conditions may be awkward for those that have them, no-one has died from one yet.

I myself have worked with radioactive materiels and while they creep the bejesus out of anyone who has anything to do with them the radiation is not overly dangerous at low levels except over long periods, say taking x-rays every day. Even spending six months in Nagasaki starting two weeks after they dropped a plutonium bomb on it didn't cause any problems among the people I know who did it.

Council honors Junior Aid Society and Girl Scouts for community ...

On November 20 the Malden City Council presented citations to nonprofit organizations the Malden Junior Aid Association and the Girl Scouts of Eastern Massachusetts in recognition of their efforts. Junior Aid is an organization which focuses on women and children.

?Be it hereby known to all that the Malden City Council hereby offers its sincerest congratulations and best wishes to the Junior Aid Association of Malden in recognition of your hundred years of dedicated service to the community and your commitment to improving the lives of others; we thank you for your effortless endeavors and are proud to have your organization vested in the city of Malden,? read? Ward 5 Councillor and Junior Aid Member Barbara Murphy, before presenting the citation to Malden Junior Aid President Mary Beth Leon.

The Malden Junior Aid Association recently donated grants to aid a number of charities, including Housing Families Inc., Bread of Life, and Mass Senior Action. ?Once a month, the members of Junior Aid cook for the homeless people at one of the hotels in Malden,? said Leon, about the organization. ?In April we joined the Malden Girl Scouts and made 36 blankets for children at the Cam Neely Facility who have cancer. In October we donated over 100 coats to the Bread of Life. Every Christmas we provide Christmas for children who are under the care of the Department of Social Services. ??Every two years we give out money to nonprofit organizations that serve the Malden area. Our focus is women, children and health and safety.?

Girl Scouts Amanda and Chelsea Sutherland and Girl Scouts? Service Unit Coordinator Heidi Sutherland receive a citation from the Malden City Council.

Council President Judi Bucci presented the second citation to Girl Scouts? Service Unit Coordinator Heidi Sutherland. The Girl Scouts and Junior Aid often work together on a number of issues.

Superstorm Sandy wreaked havoc on parts of the U.S. East Coast a month ago Thursday after tearing through the Caribbean. In the weeks since, the storm's scope has come into sharper focus.

DEATHS

Sandy killed at least 125 people in the United States. That includes 60 in New York ? 43 of them in New York City ? 34 in New Jersey and 16 in Pennsylvania. At least seven people died in West Virginia, where the storm dropped heavy snow. Sandy killed 71 people in the Caribbean, including 54 in Haiti.

LOSSES

Sandy is being blamed for about $62 billion in damage and other losses in the U.S., the vast majority of it in New York and New Jersey, a number that could increase. It's the second-costliest storm in U.S. history after 2005's Hurricane Katrina, which caused $128 billion in damage in inflation-adjusted dollars. Sandy caused at least $315 million in damage in the Caribbean.

DAMAGE

Sandy damaged or destroyed homes and businesses, more than 72,000 in New Jersey alone. In New York, 305,000 housing units were damaged or destroyed and more than 265,000 businesses affected. In Cuba, the number of damaged homes has been estimated at 130,000 to 200,000.

DISASTER AID

The governors of New York, New Jersey and Connecticut are mounting a united effort to get federal aid for the region. New York is seeking $42 billion, including about $9 billion for projects to head off damage in future storms; New Jersey wants $37 billion, including $7.4 billion for future projects; and Connecticut seeks $3.2 billion for the future.

MAGNITUDE

The National Hurricane Center now says tropical force winds extended 820 miles at their widest, down from an earlier estimate of 1,000 miles. Sandy's pure kinetic energy for storm surge and wave "destruction potential" reached a 5.8 on the National Oceanic and Atmospheric Administration's 0 to 6 scale, the highest measured.

The American Civil Liberties Union Foundation of Texas is accepting applications for summer 2013 Legal Program internships.? The ACLU is one of the nation?s foremost defenders of civil liberties and civil rights.? We are a nonpartisan organization dedicated to defending the Bill of Rights through litigation, legislation, and public education.? The Texas affiliate of the ACLU, founded in 1938, is headquartered in Houston, and includes regional offices in Austin and Brownsville.

The ACLU Foundation of Texas? Legal Program seeks highly motivated law students, with a demonstrated commitment to civil rights and civil liberties, and the initiative and energy to see projects to completion.? Preference will be given to second-year law students.? First-year law applicants should have a demonstrated commitment to civil rights.? Spanish language ability is preferred.

Legal Program interns will be supervised by the ACLU Foundation of Texas? Legal Director and/or staff attorneys.? Assignments include:

  • Assisting in litigation;
  • Investigating complaints;
  • Completing fact research and legal analysis; and
  • Drafting memoranda in preparation for litigation of civil rights cases.

The ACLU of Texas works across the spectrum of the Bill of Rights.? Our campaign priorities for 2011-2013 are Immigrants Rights, Youth Rights, Religious Freedom, and Criminal Law Reform.? Each intern will be assigned primary responsibility for working on cases and investigations in one or more of the campaign areas below and efforts will be made to accommodate the particular interests of each intern.

  • Immigrant Rights Campaign:? focus is on ending state and local law enforcement of federal immigration law; ensuring equal protection of the law to all non-citizens; stopping abuse of power by federal authorities along our border; and ending civil immigration detention and sub-standard living conditions for non-citizens in custody.
  • ? Criminal Law Reform Campaign: focus is on ending over-incarceration in Texas with an emphasis on eliminating racial disproportionality; ending the privatization of prisons and jails in Texas; and ending the death penalty in Texas.??
  • Religious Freedom Campaign: focus is on ensuring K-12 public school curriculum and textbooks are free from government-sponsored religion; promoting the separation of church and state on public school campuses; and ensuring Texans are able to practice their faiths, or no faith at all, without government interference.
  • Youth Rights Campaign:? focus is on keeping students from entering the criminal justice system; ending the use of solitary confinement of children in prisons and jails; and ensuring all children are treated equally in Texas schools.

Legal Program interns have the opportunity to participate in ACLU Foundation of Texas summer internship events, such as workshops, meetings with civil rights and social justice lawyers from around Texas, social events, and summer outings.

Funding

Unfortunately, the ACLU Foundation of Texas is unable to fund summer internships; however, we will assist students to obtain their own funding in any way we can.? We have had significant success working with students to secure grants and fellowship funding.? We will also assist students who wish to obtain clinical or academic credit for their internship.

For students attending law school outside of Texas, positions will be filled on a rolling basis.? Second-year law students should apply as soon as possible; first-year law students as soon after December 1 as possible.

President signs whistle-blower bill for US workers

WASHINGTON (AP) ? President Barack Obama signed legislation Tuesday that affords greater protection to federal employees who expose fraud, waste and abuse in government operations.

Capping a 13-year effort by supporters of whistle-blower rights, the new law closes loopholes created by court rulings, which removed protections for federal whistle-blowers. One loophole specified that whistle-blowers were only protected when they were the first to report misconduct.

Obama also signed legislation that protects U.S. airlines from having to pay into a European Union program to cut down on pollutants. Earlier this month, the EU postponed its enforcement of the payment for non-EU airlines amid protests from numerous countries and threats of a possible trade war.

The whistle-blower law makes it easier to punish supervisors who try to retaliate against the government workers.

The federal official who investigates retaliation, Special Counsel Carolyn Lerner, said her office "stands ready to implement these important reforms, which will better ensure that no employee suffers retaliation for speaking out against government waste or misconduct."

The new legislation, however, would go beyond restoring protections, to expand whistle-blower rights and clarify certain protections. For example, whistle-blowers could challenge the consequences of government policy decisions.

Specific protections would be given to certain employees, including government scientists who challenge censorship. Workers at the Transportation Security Administration, who provide airport security, would be covered under the law for the first time.

The law also would clarify that whistleblowers have the right to communicate with Congress.

To stop illegal retaliation, the law would make it easier to discipline those responsible, by modifying the burden of proof required when taking action against those trying to punish whistle-blowers. Also, the Office of Special Counsel, which was established to protect federal employees, would no longer be liable for attorney fees of government managers if the office does not prevail in a disciplinary action.

The new law would suspend the Federal Circuit Court of Appeals' sole jurisdiction to review decisions in whistle-blower cases.

The law's supporters said the court consistently narrowed protections and ruled for whistle-blowers only three times in 229 cases between October 1994 and May 2012. A review by all federal circuit courts was added as a two-year experiment.

Tom Devine, legal director of the Government Accountability Project, said, "This reform took 13 years to pass because it can make so much difference against fraud, waste and abuse. Government managers at all levels made pleas and repeatedly blocked the bill through procedural sabotage."

Devine, whose organization represents whistle-blowers, said the bill sailed through Congress once some senators who previously worked in secret to block a vote dropped their opposition.

The new airlines law was a response to an EU program that places a cap on carbon dioxide emissions from industrial polluters. Early this year, the law was expanded to include all airlines flying into and out of Europe.

U.S. airlines complained that they would be charged even for the emissions discharged over the United States or the Atlantic on their way to European destinations. The U.S. industry says it would cost it some $3.1 billion between 2012 and 2020. Those payments were to start in April, but the EU postponed that earlier this month.

"Although European leaders have temporarily pulled back their tax proposal, the law signed by the president today will help ensure the EU scheme will not resurface next year like a phoenix rising from the ashes," said Rep. John Mica of Florida, the Republican chairman of the House Transportation Committee,

The airlines emissions legislation requires the transportation secretary to prohibit U.S. airlines from paying into the EU emissions program if that prohibition is deemed in the public interest. It also urges the administration to engage in international talks to seek a global approach to aircraft emissions.

"The Obama administration should seek binding regulations and limits on such pollution when it meets with international partners to establish these rules at the International Civil Aviation Organization," said Sarah Saylor of the environmental group Earthjustice.

Obama also signed legislation that permits construction of a natural gas pipeline within certain areas of the Gateway National Recreation Area in New York City.

He also signed into law legislation that sets a cost-of-living adjustment for veterans who receive disability compensation. The increase is estimated to amount to about 1.9 percent.

'Killing Them Softly' Review: Brad Pitt Film Hammers Its Message Hard

-- Writer-director Andrew Dominik's "Killing Them Softly" is an incredibly stylish genre exercise set in the world of mobsters, junkies and lowlifes, but it's also trying incredibly hard to be About Something.

Not content merely to be profane, abrasive and occasionally, darkly amusing, it also wants to be relevant. And so Dominik has taken the 1974 crime novel "Cogan's Trade" by George V. Higgins and set it in the days before the 2008 presidential election, just as the U.S. economy is in the midst of catastrophic collapse. Every television and radio is tuned to then-candidate Barack Obama or President George W. Bush addressing the nation ? even in bars and thugs' cars ? with the volume cranked way up, commenting all-too obviously on the film's action.

As if we couldn't decipher for ourselves that organized crime functions as its own form of capitalism, "Killing Them Softly" turns on the mini-implosion that occurs when a couple of idiots rob a mob-protected card game. Scoot McNairy plays the jittery ex-con Frankie; his inept partner in crime is an Australian heroin addict played by Ben Mendelsohn. Both are aggressively grungy. As they get away with briefcases full of cash, we hear Bush in the background, asking rhetorically, "What does this mean for your financial future?" Could it really be that obvious?

The corporate types at the top of the syndicate, represented by an uptight, humorless (and nameless) Richard Jenkins, want to restore order, so they ask Jackie Cogan, an enforcer played by Brad Pitt (star of Dominik's haunting, poetic "The Assassination of Jesse James by the Coward Robert Ford"), to investigate the heist and punish the perpetrators. This is one of those effortless Pitt performances that exemplify how beautifully he manages to be both a serious actor and a superstar; the slicked-back hair, aviator sunglasses and gold chains are a showy shorthand to signify he's a dangerous guy, but the consistently surprising choices he makes with the rat-a-tat dialogue reveal his character's intelligence.

Jackie brings in an old colleague, veteran hit man Mickey (James Gandolfini), to take out the robbers and send a message to the rest of the criminal world. The scenes these two actors share are by far the film's best, including one in which they sit at a bar and quietly catch up on everything from work to marriage to alcoholism; they're so different in tone from everything else, they feel like they're part of an entirely separate movie. Gandolfini's character is the only one who feels like a complete and complicated person: brazen and abusive but also sentimental and deeply insecure.

At the other end of the aesthetic spectrum is the artfully graphic pummeling some of these characters take, particularly Ray Liotta as the guy who runs the card game in question (and once got caught trying to rob it himself). The hard thwack of a fist against a jaw matches the pummel of rain and the splatter of blood. Bullets fire from a handgun in super-slow motion, piercing the raindrops, then a car window, then someone's skull. It's all very painstaking and cool-looking (the work of the gifted cinematographer Greig Fraser) but it also feels like part of a prevalent cynicism, given the film's heavy-handed message.

"America's not a country, it's just a business," Jackie declares in the film's final monologue, a message "Killing Them Softly" already had hammered pretty hard during the previous hour and a half.

"Killing Them Softly," a Weinstein Co. release, is rated R for violence, sexual references, pervasive language and some drug use. Running time: 97 minutes. Two stars out of four.
